Terms & Conditions : All products quoted are subject to availability. Should any product not be available at the time of the clients’ fireworks display event they will be substituted with a product of equal value and quality. Depending on site conditions on the date of the display, products may be changed to ensure compliance with state regulations and our safety management system and procedures including the risk assessment process. Insurance: Aerial Pyro-Tech has a $20M Public and Product Liability Insurance policy. If you require a copy of our policy, it must be made a minimum of 7 working days prior to the fireworks display event. Safety: Aerial Pyro-Tech will determine where it is safe for the public to view the fireworks display. Aerial Pyro-Tech will provide and use bunting to secure the firing site. Crowd control, security and any safety fencing for the fireworks display (before, during and after) is the responsibility of the client. The event organiser is to obtain permission for use of the land from the land owner a minimum of 14 days prior to the fireworks display. Aerial Pyro-Tech will assist where possible. The event organiser is to notify the surrounding neighbours of the display date, display time, and display location a minimum of 3 days prior to the event. If the client is dissatisfied with our service or products used or product and/or display malfunction occurs, it must be reported to the display manager or Aerial Pyro-Tech within 24hrs of the display. Cancellation: Aerial Pyro-Tech have the right through legal and safety obligations to cancel our fireworks display prior to or during the celebration due to public breaching security and/or safety distances, product malfunctions or adverse weather conditions without incurring payment penalties from the client. A client can cancel a fireworks display, but 30 days written notice is required to be sent to Aerial Pyro-Tech. If the client cancels the fireworks display event within the 30 days of the display a cancellation fee will be charged. This fee will be charged based on the administration, labour, packing, loading and unloading, transport costs, and any additional equipment costs required for that display. The maximum cost will not exceed 50% of the total agreed contract price. The 30% deposit is non-refundable if the clients’ cancellation is within 7 days of the fireworks display event. If the cancellation is due to a total fire ban and the authorisation of the display has not been approved by the local fire authority, a full refund of monies paid by the client will be refunded. In the event of adverse weather conditions, both Aerial Pyro-Tech and the event organiser can agree to cancel, postpone, or delay the fireworks display. In the event of cancellation, a cancellation fee will apply. Should any services be subcontracted out by Aerial Pyro-Tech which is provided as part of the agreed fireworks display and the fireworks display event is cancelled the client must pay all costs for these services in full within 7 days of cancellation (i.e. Barge hire, security services, etc.). Payment: A 30% deposit is required within 7 days of the clients’ booking. The balance is due prior to or on the night of the fireworks display event. If direct deposit is used, it must be cleared, a minimum of 48 hours prior to the display. If payment is made on the night, it is to be paid prior to the display commencement and can be in the form of cash payment only or receipt of deposit made, unless other arrangements have been made with Aerial Pyro-Tech finance department. Full payment must be completed on or before the day of the fireworks display prior to firing unless otherwise agreed.
